What we agree to do, and what we do not

Draft — not for publication Clauses 1, 5, 7 and 10 in particular need the lawyer's hand: the description of the service boundary is the compliance position of the whole business, and German consumer law constrains what the liability, cancellation and governing-law clauses may say. Do not publish before the StBerG opinion (GTX-003) and the partner agreement are in place.

1. What Indo German Tax is, and is not

Indo German Tax provides marketing, eligibility screening, document collection, file preparation and client communication. Indo German Tax is not a tax advisory firm and does not provide tax advice.

All review of your documents, all decisions about what may be claimed, and the preparation and electronic submission of your tax return are carried out exclusively by an independent licensed German Steuerberater (the "Adviser"), who is responsible for that work under their own professional obligations and professional indemnity insurance.

If you ask us a question that only a licensed adviser may answer, we will not answer it ourselves. We will put it to the Adviser and pass their answer back to you.

2. Anything we show you before filing is indicative

Averages, typical ranges and eligibility results shown on our website or in conversation are drawn from published figures for groups of people. They are not a calculation of your refund, not an assessment, and not a promise. What you actually receive is determined by the Finanzamt after the Adviser has reviewed and filed your return. You have no claim against us if the outcome differs from any figure shown to you.

3. What we will do for you

Screen your situation and tell you plainly if we think filing is not worth your time.
Give you a single fixed checklist of documents and chase you until the file is complete.
Assemble the file in the format the Adviser requires and pass it to them once you have agreed.
Relay the Adviser's questions and answers.
Keep you informed while the tax office processes the return, and until payment reaches you.
For pension refunds: prepare the application forms for your signature and track the claim. [Scope of our involvement in pension claims to be confirmed by the lawyer.]

4. What you agree to do

Give us truthful and complete information and documents, respond when we ask for something, and sign the Adviser's authorisation where it is needed. The return is filed on the basis of what you tell us, so you remain responsible for the accuracy of your own information.

5. Fees

Our fees are flat, fixed per case type, and independent of the size of any refund. They are payable in advance. The Adviser's own filing fee is charged separately and is quoted to you in writing before you commit.

If it turns out not to be worthwhile: if the Adviser concludes before filing that there is no worthwhile refund, we refund our fee minus a fixed processing charge for work already carried out, stated when you agree the fee.

If you cancel: before we begin collecting documents, a full refund minus the same charge. After collection has begun but before filing, [proportion — to be set]. Once your return has been filed, no refund, because the work is complete.

6. We cannot promise an outcome

Refund amounts, processing times and the decisions of the Finanzamt and the Deutsche Rentenversicherung are outside our control. Processing typically takes six to twelve weeks and is sometimes considerably longer. Your refund is paid by the authority directly into your own account; we never receive it.

7. Liability

We are liable for our own administrative services. Our liability is limited to [the fee you paid], except in cases of intent or gross negligence, and except for injury to life, body or health. The Adviser is solely responsible for the tax-professional work. [Clause to be settled by the lawyer against German consumer law.]

8. Talking on WhatsApp

You agree to us communicating with you on WhatsApp about your case. You can ask to move to email at any time. Message STOP to stop anything that is not directly about your case.

9. Ending the engagement

Either of us may end the engagement before filing; clause 5 covers what that means financially. We may decline or discontinue a case that cannot be completed truthfully or lawfully.

10. Law and disputes

[Governing law, jurisdiction, mandatory consumer protection rules, and the EU online dispute resolution notice — all depend on the entity structure, which is itself sequenced after the legal opinion.]

11. Changes to these terms

We may update these terms. Where a change is material we will tell you before it applies to your case.
